Terms of Use

Please read these terms carefully before using the Nestilife mobile app and the nestilife.com website (the "Service"). By using the Service, you agree to these terms.

1. Description of the Service

Nestilife is a mobile app and related web service that lets family members share location, driving, and safety data, with emergency features such as crash detection and SOS.

2. Age and Accounts

• Children under 13 cannot use the Service; they are blocked at the age gate during sign-up.
• Users aged 13–17 can sign up only with parental consent; their account is placed in Kid Mode.
• Users 18 and older can create a full-access account.
• You are responsible for the confidentiality of your account credentials and for all activity performed via your account.

3. Acceptable Use

You agree to use the Service only for lawful purposes. You will not:

• Track another person without their consent (adult family members are deemed to have consented to location sharing by joining the Service).
• Use the Service for unauthorized access, harassment, threats, or illegal surveillance.
• Attack the Service's infrastructure, reverse engineer it, or inject malicious code.
• Create fake accounts or impersonate others.
• Access the Service with automated tools (bots, scrapers).
• Use the SOS feature outside of a genuine emergency.
• Share content that is unlawful or contrary to public order.

3A. Zero Tolerance for Objectionable Content and Abuse

Nestilife has zero tolerance for objectionable content and abusive users in user-generated content, including family chat messages, names, and profile information. The following are strictly prohibited and may result in immediate suspension or termination of your account:

• Profanity, insults, hate speech, harassment, bullying, or threats.
• Sexually explicit content, content glorifying violence, or unlawful content.
• Spam, unwanted content, or impersonation of another person.

Nestilife automatically filters objectionable content. Users can report any message or person from within the app and block abusive users — a blocked person's content is removed from your feed instantly and our team is notified. We review every report within 24 hours, removing reported content and suspending or terminating the offending user's account where warranted.

4. Location Sharing and Privacy

The Service shares your location only with members of your family group. You can disable location sharing at any time, but doing so will limit the core features of the Service.

5. Emergency Features (SOS, Crash Detection)

The SOS and crash detection features do not replace traditional emergency services. Emergency notifications may be delayed or fail due to battery condition, network availability, sensor performance, or software bugs.

In a life-threatening situation, always dial your local emergency number directly (e.g., 112 in Turkey/EU, 911 in the U.S.).

6. Premium Subscription (Nestilife+)

Nestilife+ unlocks advanced features (unlimited location history, crash detection, driver coaching, ad-free experience, priority support). The following terms apply:

• Nestilife+ subscriptions are purchased and managed through the Apple App Store or Google Play.
• Monthly or yearly plans are available. Pricing is shown in your local currency by the store.
• Subscriptions auto-renew. Unless cancelled at least 24 hours before the end of the current period, you are charged for the next period.
• Cancel through your device settings (Apple ID / Google Account subscriptions section).
• If a free trial is offered, it converts to a paid subscription at the end of the trial unless cancelled in time.
• Refund requests are governed by Apple App Store / Google Play refund policies.

7. Intellectual Property

The Nestilife app, source code, design, brand, and content belong to Nestilife and are protected by copyright, trademark, and other intellectual property laws. Your use of the Service grants you a limited, non-exclusive, non-transferable right to use, but no ownership rights.

8. Account Deletion

You can delete your account with one tap from within the app. After deletion, all your data is irreversibly removed within 30 days. This action is irreversible; we recommend downloading your data first (Privacy > Download my data).

9. Termination

We reserve the right to suspend or terminate your access to the Service for:

• Violation of these terms
• Conduct that harms other users or the Service infrastructure
• Requests from legal authorities
• Suspected fraud or identity theft

10. Disclaimer of Warranties

The Service is provided "as is". We make no express or implied warranties that it will be uninterrupted, error-free, or meet all expectations. To the maximum extent permitted by law, Nestilife is not liable for:

• Location data that is delayed, inaccurate, or missing
• Failure of crash detection or SOS features
• Outages of third-party services (push, maps, IAP)
• Issues caused by device battery, network, or GPS signal
• Direct, indirect, incidental, special, or consequential damages

Our liability shall in no case exceed the amount you have paid us for the Service over the last 12 months.

11. Indemnification

You agree to indemnify Nestilife against any third-party claim arising from your misuse of the Service.

12. Changes to These Terms

These terms may be updated from time to time. We announce material changes via in-app message and email. Your continued use of the Service after changes means you accept the new terms.

13. Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of Turkey. Disputes are subject to the jurisdiction of the courts of Istanbul. Consumers residing in the EU retain rights granted under their local consumer law.

14. Entire Agreement

These terms together with the Privacy Policy constitute the entire agreement between you and Nestilife regarding your use of the Service. If any provision is held invalid, the remaining provisions remain in force.
